Your booking cannot be cancelled or refunded but can be transferred to another person if you cannot make the camp.
For valuable consideration received, I grant BA Innovations Pty Ltd (Effortless Swimming) the absolute and irrevocable right and unrestricted permission concerning any photographs that the business has taken or may take of me or in which I may be included with others, to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if he/she so chooses. I release and discharge BA Innovations Pty Ltd from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorisation and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of BA Innovations Pty Ltd, as well as the person(s) for whom he/she took the photographs. I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns. TO THE CUSTOMER: By taking part in the any of the activities we offer you are assuming a degree of risk. Please read the following carefully & do not sign it if you do not understand it or do not agree with its terms. BA Innovations Pty Ltd ("Effortless Swimming") carries on the business of swimming training camps ('the Services') . In consideration of Effortless Swimming agreeing to offer its Services set out below, I, by ticking the box I agree as follows: 1. Prior to embarking on any tour or activity comprising any one or more of the Services, the Services and what they entail have been thoroughly explained to me; 2. I am physically fit and suffer from no medical condition which may be aggravated by my taking part in any one or more of the activities comprising the Services 3. I consent to receive medical treatment in the event of any medical emergency during my taking part in any one or more of the activities comprising the Services 4. For myself, my executors, heirs and assigns I further agree to: a) Avail myself of the Services or any of them at my own risk b) Release Effortless Swimming, it assigns, employees and agents to the full extent permitted by law from all claims, costs, damages, liabilities and losses arising from any incident howsoever caused including without limit through negligence and resulting in injury or death to any person or property damage sustained by me during my use of the Services. c) Indemnify Effortless Swimming from and against all claims, proceedings, costs, damages, liabilities and losses which Effortless Swimming may become liable for arising from any loss, damage, death or injury sustained and caused or contributed to by my use of the Services. 5. I warrant that I am over eighteen (18) years. 6. As the participant, I confirm that I am aware that this document is a legal document, I have signed at my own free will knowing that I have relinquished important legal rights.
